This Privacy Policy describes how we handle your personal information for our services on Flight Derby™, applying to the Flight Derby™ website and content where this policy appears in the footer of the page. Some websites we operate may be governed by separate privacy policies. The policy that applies on any of our domains or sub domains is always the policy that appears in the footer of each website. Flight Derby™ is subject to the requirements of applicable law.

By accepting the Privacy Policy and the User Agreement in registration, you expressly consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for new users and is otherwise effective on June 14th, 2011.

Collection

Anyone may visit and browse Flight Derby™ with complete anonymity. Once a person provides personal information of any kind they are no longer anonymous to us. If a person chooses to provide personal information, they thereby consent to the transfer and storage of that information on our servers located in the United States.

We may collect and store the following personal information:

  • E-mail address, physical contact information, the organization to which a person belongs, and if applicable financial information such as credit card or bank account numbers.
  • Transactional information based on activities on the sites (such as bidding, buying, wagers, comments that apply to a person's account account);
  • Shipping, billing and other information provided for the purpose of purchasing points or credits or anything else for sale on Flight Derby™.
  • Any community discussions, chats, dispute resolution, correspondence through our sites, and correspondence that is sent to Flight Derby™ through our site, Facebook page, Twitter account or any other social media outlet.
  • Any other information as a result of interaction with our sites, services, content and advertising, including computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information.
  • Additional information requested to authenticate a user of the site or if a user is suspected of violating site policies (for example, we may request an ID or bill to verify the address of a user, or to answer additional questions online to help verify identity or ownership of an item listed for sale of its naming rights).
  • Information from other companies, such as demographic and navigation data, and other supplemental information from third parties (for example, if a person incurs a debt to Flight Derby™ we will generally conduct a credit check by obtaining additional information about that person from a credit bureau, as permitted by law).

    • Marketing

    Flight Derby™ does not sell or rent personal information to third parties for marketing purposes without a person's explicit consent. However, we may combine a person's information with information we collect from other companies and use it to improve and personalize our services, content and advertising.

    Use

    The primary purpose in collecting personal information is to provide users a secure and efficient forum in which to play our game. By agreeing to this Privacy Policy the user allows that Flight Derby™ use their personal information to:

    • Provide the services and customer support requested by the user.
    • Resolve any disputes, collect fees, and troubleshoot problems related to our services.
    • Prevent potentially prohibited or illegal activities.
    • Enforce Flight Derby™'s User Agreement.
    • Customize, measure and improve services, content and advertising of Flight Derby™
    • Inform about the services of Flight Derby™, targeted marketing, service updates, and promotional offers based on the communication preferences of the user.
    • Compare personal information of a person for accuracy, and verify it with third parties.
      • Disclosure of Personal Information Flight Derby™ may disclose personal information in response to legal requirements or to claims that a player has violated the rights of others, to enforce the policies of Flight Derby™, or protect any persons rights, property, or safety. This information will be disclosed in accordance with applicable laws and regulations. Personal information may also be shared with:
    • Service providers under contract helping with business operations of Flight Derby™ (for example fraud investigations or bill collection).
    • Other third parties to whom a user explicitly requests that Flight Derby™ send their information (or about whom a user is otherwise explicitly notified and provides their consent to send information to when using a specific service).
    • Law enforcement or governmental officials in response to a verified request relating to a criminal investigation or alleged illegal activity that we, in our sole discretion, believe appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, Flight Derby™ will disclose information relevant to the investigation, such as name, city, state, zip code, telephone number, email address, user ID history, IP address, fraud complaints, and bidding and listing history.
    • Other business entities, in the case that we plan to merge with or be acquired by that business entity.

    Without limiting the above, in an effort to respect privacy and the ability of Flight Derby™ to keep the community free from illegal actions, we will not otherwise disclose personal information to law enforcement, government officials, or other third parties without a subpoena, court order or similar and substantial legal procedure, except when we have reason to believe that the disclosure of information is necessary for prevention of imminent physical harm or financial loss, or to report any suspected illegal activity.

    Information Shared on Flight Derby™

    A user's User ID is connected to all activity on Flight Derby™ and is displayed throughout Flight Derby™ (thus available to the public). Wagers, purchases, items for sale, winnings, feedback, ratings and associated comments and etc. are visible to the public. Any notices sent to other users or persons about suspicious activity and/or policy violations on our sites refer to User IDs and specific items. So if a user associates their name with their User ID, the people to whom they have revealed their name will be able to personally identify that user’s activities on Flight Derby™.

    If a person accesses our sites from a shared or public computer, such as a computer in an internet café, certain information about that person, such as their User ID, activity or notices from Flight Derby™, may also be visible to other individuals who use the computer.

    Using Information from Flight Derby™

    Flight Derby™ enables a person or user to share personal and financial information in order to complete transactions. We encourage users to disclose privacy practices and respect the privacy of other users. We cannot guarantee the privacy or security of anyone's information and therefore encourage users to evaluate the privacy and security policies of their transaction partner/s before entering into a transaction and choosing to share information. To help protect users' privacy, we allow limited access to other users' contact, shipping and financial information. When involved in a transaction, users may have access to each others' name, User ID, e-mail address and other contact and shipping information. In all cases, users must give one another a chance to remove themselves from a user's database and to review what information has been collected about them.

    This agreements allows the use of user information for:

    • Transaction purposes related to Flight Derby™that are not unsolicited commercial messages.
    • Services offered through Flight Derby™ (such as awards and fraud complaints).
    • Any other purposes expressly expressed by a user.

    Cookies

    We use "cookies" (small files placed on the hard drive) to help analyze our web page flow; customize our services, content and advertising; measure promotional effectiveness; and promote trust and safety among our users. We may offer certain features that are only available through the use of cookies. We may also use cookies to help identify persons and users and to maintain their signed-in status.

    Most cookies will automatically be deleted from a user’s hard drive at the end of a session.

    A person is free to decline Flight Derby™ cookies if their browser permits. However, doing so may interfere with the use of some of our sites and/or services.

    A person may encounter cookies from third parties on certain pages of the sites not controlled by Flight Derby™.

    Spam or Other Malicious Content

    Flight Derby™ does not tolerate spam. Users should make sure to set their Flight Derby™ communication preferences so we communicate to them as they prefer. Users are not licensed to add other users of Flight Derby™ to mailing lists (e-mail or physical mail) without expressed consent of the user. Please report to Flight Derby™-related spam or spoof . No person may use the communication tools of Flight Derby™ to send spam or other content in violation of our User Agreement. Flight Derby™ is prepared to scan and may manually filter messages to check for spam, viruses, phishing attacks and other malicious or illegal activity or content. However, we do not permanently store messages sent through these tools. For anyone who sends an email to an email address not registered in the Flight Derby™ community, we do not permanently store that email, or use, rent or sell that email address for any marketing purpose.

    Account Protection

    A user's password is the key to their account. Passwords should incorporate unique numbers, letters and special characters. Users should not disclose their Flight Derby™ password to anyone. If a user chooses to share their password or personal information with others they are responsible for all actions taken in the name of that account. If a user loses control of their password, they may in turn lose substantial control over personal information and could be subject to legally binding actions taken on the user's behalf. If for any reason a user's password has been compromised they should immediately notify Flight Derby™ and change their password.

    Accessing, Reviewing and Changing Your Personal Information

    You may see, review and change most of their personal information by signing on to Flight Derby™. We will generally not manually modify personal information because of the difficulty in verifying a person's identity remotely. Persons or users must promptly update their personal information if the information changes or is inaccurate. A user may not be able to change or remove a posting once it is made public. Upon request, Flight Derby™ will close any person's account and remove their personal information from view as soon as reasonably possible, based on the account activity and in accordance with applicable law. We retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce the Flight Derby™ User Agreement, and to take any actions otherwise permitted by law.

    Security

    User information is stored on our servers located in the United States. Flight Derby™ will strive to protect users' personal information against unauthorized access and/or disclosure. However, third parties may unlawfully intercept or access transmissions or private communications, and users may potentially abuse one another's personal information collected from Flight Derby™. We work hard to protect the privacy of our users, but we do not promise that personal information or communications will always remain private.

    Third Parties

    Except as otherwise explicitly included in this Privacy Policy, this document addresses only the use and disclosure of information collected from users. Flight Derby™ does not control the privacy policies of third parties. Persons are subject to the privacy policies of those third parties where applicable. If a person discloses their information to others, whether bidders, buyers or sellers, on Flight Derby™ or other sites throughout the Internet, different rules may apply to their use or disclosure of the information provided.

    Amendments

    We reserve the right to amend this Privacy Policy at any time by posting the amended terms on this site. Amended terms will automatically take effect 2 days after they are initially posted on the site.
